Heard the learned counsel for the petitioner as well as Mr. J. N. Thakur, the learned Additional Public Prosecutor for the State.
The petitioner apprehends his arrest in connection with Surajpura P.S. Case No. 03/2021 registered for offence punishable under sections 409 and 420 of the Indian Penal Code.
As per allegation mentioned in the FIR, the petitioner received Rs. 11,00,000/- for completion of the work of Naljal Scheme, but he completed the work only upto Rs.5,00,000/-. The learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.35052 of 2021(3) dt.28-07-2022 2/2 that in paragraph nos. 6, 7 and 8 of the case diary, the witnesses including the Gram Sevak, have stated that the work upto Rs.9,11,597/- has been completed. He has also submitted that the petitioner is ready to refund the remaining amount. Considering the fact that most of the work has been completed and the petitioner is ready to refund the remaining dues on him, let him, in the event of his arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Rohtas at Sasaram in connection with Surajpura P.S. Case No. 03/2021, subject to condition as laid down under section 438(2) Cr. P.C. The bail bond shall be confirmed only after deposit of the remaining dues on the petitioner.
Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
