The petitioners apprehend their arrest in Lakhisarai P.S. case No. 98 of 2017 under Section 354(D)/34 of the Indian Penal Code and under Section 11 (1) (IV) of the POCSO Act. The informant alleged that while she along with her friend was going to school both the petitioners stalked the informant and her friend and asked them to accompany them for solemnizing marriage.
The learned counsel for the petitioner submits that the petitioners are co-villagers. No occurrence, as alleged, has ever taken place. The informant was having love affairs. The informant wrote love letters (Annexure-3) but it appears that informant is a minor girl and the petitioners stalked her while she was going to school.
Patna High Court Cr.Misc. No.19175 of 2017 (3) dt.06-07-2017 2/2 Considering the facts aforesaid and the nature of allegation made against the petitioners, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
