The petitioner is apprehending her arrest in connection with Dhaka P.S. Case No. 307 of 2016 for the offences instituted under Sections 304(B)/34 of the IPC.
The prosecution story, in brief, is that on 20.10.2016 in the morning the informant received information that his daughter has been murdered by strangulation her neck. Then he alongwith his villagers arrived at village-Garahiya where they saw half burnt dead body of his daughter. It is also alleged that after marriage of her daughter her husband Brij Mohan Prasad and mother-in-law Meena Devi has treated his daughter with cruelty for demand of
Patna High Court Cr.Misc. No.28476 of 2017 (2) dt.06-07-2017 2/2 motor cycle, gold chain and T.V. and the said incident is committed by her husband and mother-in-law.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. She has falsely been implicated in the present case. The petitioner is the mother-in-law of the deceased. She is a lady. It is further submitted that the petitioner is separate in mess and property from the husband of the deceased.
On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of her arrest or surrender before the learned court below within a period of six weeks from today in connection with Dhaka P.S. Case No. 307/2016 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M. Sikrahana at Dhaka, East Champaran, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
