JUSTICE ANIL KUMAR SINHA ORAL ORDER 13-10-2020 Heard Mr. Arvind Kumar Mouar, learned counsel for the petitioner and Mr. Sanjay Kumar Singh, Additional Public Prosecutor for the state through video conferencing.

2. Petitioner seeks regular bail in connection with Pandarak PS Case No. 07/2020 registered for the offence punishable under Sections 25(1-b)a, 26, 27 and 35 of the Arms Act.

3. The allegation against the petitioner, as per First Information Report, is that a loaded country made pistol has been recovered from the possession of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and has falsely been implicated in this case. Learned counsel for the petitioner further submits that from perusal of the seizure list, it would be evident that the pistol in question has not been

Patna High Court CR. MISC. No.26542 of 2020(2) dt.13-10-2020 2/2 recovered from the conscious possession of the petitioner and the same has been recovered from bank of the river Ganges behind the Pandarak Block. Learned counsel also submits that petitioner is in custody since 24.01.2020.

5. Having regard to the submissions made by the parties and taking into consideration the material on record and the fact that the petitioner is in custody since 24.01.2020, I am inclined to grant regular bail to the petitioner.

6. Accordingly, let the petitioner, RANJEET KUMAR RAM @ FIRAM be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Barh in connection with Pandarak PS Case No. 07/2020.

7. It is made clear that at the time of furnishing bail bonds all the parties shall follow the guidelines regarding lockdown and social distancing.
