The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 342, 323, 307, 363, 354, 376/ 511, 493, 496, 420, 120B, 506/34 of the Indian Penal Code and 25(1-B)a, 26, 35 of the Arms Act.
The prosecution case is that co-villagers of the informant Nand Kishore Mishra took informant and her mother to Ranchi where Nand Kishore Mishra and Amarendra Singh got her marriage forcibly with mentally retarded person. Subsequently, the in-laws of the informant started inflicting torture, as a result she escape
Patna High Court Cr.Misc. No.51084 of 2015 (2) dt.09-11-2015 from the maternal house and came to his mothers house and narrated the incident. On 06.07.2015 in night Nand Kishore Mishra, Amarendra Singh and this petitioner entered into the house of the informant and abducted the informant. On alarm being raised the accused Amarendra Singh fired with pistol. The accused persons took away cash Rs.5,000/- and ornaments from the house of the informant.
It is submitted by the learned counsel for the petitioner that thrust of accusation is against Nand Kishore Mishra and Amarendra Singh. The petitioner has been roped in the present case, who happens to be maternal uncle of the husband of the informant. For the last occurrence of 06.07.2015 the First Information Report was registered on 09.07.2015. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.
Considering the delayed lodging of the case and the thrust of accusation is against Amrendra Singh and Nand Kishore Mishra, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, West Muzaffarpur in connection with Deoriya P.S. Case No. 53 of 2015, subject to
Patna High Court Cr.Misc. No.51084 of 2015 (2) dt.09-11-2015 conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
