The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 457, 380, 411, 413, 414, 404/34 of the Indian Penal Code. According to FIR, prosecution case relates to theft of jewelry as well as cash of Rs. 27,500/- after broken the main gate of the house of the informant by unknown miscreants. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is not named in the FIR rather he has been made accused in this case on the basis of his self confessional statement which was recorded in Bagaha (Pathkhauli) P.S. Case No. 743 of 2022. So called confessional statement is

It is further submitted that as alleged stolen article has been recovered from co-accused Laxman Kewal. Neither the petitioner has been put on TI Parade nor any stolen article has been recovered from possession of this petitioner. Moreover, the petitioner is languishing in judicial custody since 2.1.2023.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bagaha (Pathkhauli) P.S. Case No. 762 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st Bagaha, West Champaran.
