JUSTICE SUDHIR SINGH ORAL ORDER 12-07-2016 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners are apprehending their arrest in connection with Beldaur P.S. Case No. 44 of 2016 for the offences instituted under Sections 366A/34 of the Indian Penal Code. As per prosecution case, the informant Subodh Kumar alleged that her daughter had gone to watch fair in premises of Gandhi High School, Beldaur and the petitioners in conspiracy with the co-accused persons lifted his daughter and carried her away by motorcycle, the informant searched his daughter and in course of search, petitioner Mantu Thakur has admitted the incident and on social pressure co-accused Arun Thakur agreed to get back the victim and the informant has shown apprehension that
Patna High Court Cr.Misc. No.27433 of 2016 (2) dt.12-07-2016 his minor daughter would have been killed or forcefully married. It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. Petitioners have falsely been implicated in the present case. The main allegation is against one Niranjan Chaudhary who is said to be in love affair with the victim. Subsequently, vide Annexure-3, a petition has been filed by the informant in the court below stating that the present case has been instituted due to mistake of fact and he does not want to pursue the present case against the petitioners and others.
On behalf of the State, it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Beldaur P.S. Case No. 44 of 2016 on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Ist Class, Khagaria, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
