Petitioner apprehends his arrest in connection with Mahila P.S.Case No. 63 of 2017 registered for the offences punishable under Section 376 of the Indian Penal Code and Sections 4/6 of POCSO Act.
Allegation against the petitioner is of committing rape on the minor daughter of informant.
Submission of learned counsel for the petitioner is that there is inordinate delay in lodging the case and prior to that petitioner has lodged a case under Section 307 IPC against brother of informant as well as the informant.
Heard learned APP also.
Having heard both sides and in view of allegation, I am
Patna High Court Cr.Misc. No.12970 of 2018 (2) dt.04-04-2018 2/2 not inclined to grant anticipatory bail to the petitioner. Prayer is rejected.
However, petitioner should surrender and pray for regular bail, which shall be considered on its own merit. With the above observation, this application is dismissed. (Vinod Kumar Sinha, J) spal/- U
