The petitioner apprehends his arrest in connection with Kharik P.S. Case No. 240 of 2017 registered under Sections 304(B), 328 of the Indian Penal Code.

The informant alleged that on 16.10.2017 his son-inlaw (petitioner) came from Delhi after earning his livelihood and started assaulting and quarreling with his daughter due to which deceased committed suicide by consuming poison. Learned counsel for the petitioner submits petitioner is the husband of the deceased and just before the occurrence, he had come from Delhi. No external injury was found on the person of the deceased. The petitioner took his wife for treatment to Mayaganj Hospital, Bhagalpur but she could not be saved.

No.17943 of 2018 (2) dt.09-04-2018 2/2 Considering the facts and from perusal of the F.I.R, it appears that petitioner has assaulted the deceased immediately after coming from Delhi to Bhagalpur and due to which she committed suicide by consuming poison, therefore, I am not inclined to grant anticipatory bail to the petitioner and his prayer for bail stands rejected in connection with Kharik P.S. Case No. 240 of 2017 pending before learned Additional Chief Judicial Magistrate, IIIrd, Naugachia, Bhagalpur.
