The petitioner has preferred this application for grant of regular bail in a case registered under sections 406 and 420 of the Indian Penal Code and section 66 of the IT Act. As per the prosecution case, the petitioner is said to have made viral the question paper of the subject Social Sciences (compulsory) of the Annual Secondary Examination, 2021.
It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case for oblique reasons. The allegations are false and concocted. He is in custody since 20.2.2021 and has no criminal antecedent. The
Patna High Court CR. MISC. No.34645 of 2021(3) dt.20-01-2022 2/2 investigation in the case has concluded.
The application for bail is opposed by learned A.P.P. for the State.
A report was called for with respect to the antecedent of the petitioner. As per the report received, the petitioner has no criminal antecedent Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for over 11 months and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Madhepura P.S. Case no. 152 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura.
