It appears that the court below has rejected the amendment application considering the proviso to Order 6 Rule 17 of the Code of Civil Procedure. The matrimonial case was filed for divorce on the ground of cruelty. Both parties have adduced evidences and the case is at the stage of argument. The order passed by the court below appears to be valid, reasoned order and it neither occasioned any failure of justice nor the amendment sought for is necessary for just decision of the controversies between the parties. Therefore, I do not find any reason to interfere with the impugned order.

Thus, this writ application is dismissed.
