Petitioner seeks bail in a case registered for the offence punishable under Section 302 of the Indian Penal Code. The third wife of this petitioner, who was the daughter of the informant, died in unnatural circumstances in her matrimonial house after more than eight years of her marriage. She was mother of a daughter aged about eight years at the time of her death.

Submission is that there is no eyewitness of the occurrence that murder was committed, rather a case of suicide by hanging for trivial family dispute was there. Petitioner is in custody since 06.01.2019.

Considering the entire facts, let the petitioner, above

Patna High Court CR. MISC. No.22833 of 2019(4) dt.11-06-2019 2/2 named, be released on bail after framing of the charges on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Dhamdaha Police Station Case No.48 of 2018, subject to condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
