JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 10-08-2016 The present application has been filed for modification of order dated 17.09.2015 passed in Cr. Misc. No. 37510 of 2015 in the grab of renewing the prayer for anticipatory bail on the ground that through supplementary affidavit it was brought on record that the co-accused was granted anticipatory bail.

The petitioner is accused in a case registered for the offences punishable under Sections 399, 402 of the Indian Penal Code and Section 25(1-B)a/26 of the Arms Act. The prosecution case is that on information that the miscreants are preparing to commit dacoity, raid was laid, when one person was apprehended, who disclosed the name of others including the petitioner, who escaped from the scene.

Patna High Court Cr.Misc. No.14799 of 2016 (2) dt.10-08-2016 2/2 The earlier anticipatory bail application of the petitioner was disposed of with liberty to surrender and pray for regular bail.

This Court is not inclined to revise the earlier order on merits. Accordingly, this application is disposed of. Let the learned court below consider the prayer for regular bail of the petitioner keeping in view of the fact that the others have been granted anticipatory bail, if the petitioner surrenders before the learned court below within a period of three weeks from the date of receipt/production of a copy of this order in connection with Dariyapur P.S. Case No. 212 of 2014, pending in the court of learned Chief Judicial Magistrate, Saran at Chapra. (Dinesh Kumar Singh, J) DKS/- U T
