Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 147, 148, 341, 307 and 504 of the Indian Penal Code and Section 27 of the Arms Act, registered in connection with Samvadi Nasriganj P.S.Case No. 06 of 2020.

As per allegation, co-accused Apurva Kishore Sinha, Abhishek Kishore Sinha and the present petitioner came to the house of the informant searching her father. When the informant

No.32785 of 2021(2) dt.31-03-2022 2/3 did not apprise the whereabouts of her father, the accused persons started dragging her away which was intervened by her uncle Ranjeet Kant Srivastava, whereupon co-accused Abhishek Kishore Sinha fired on him. Co-accused Abhishek Kishore Sinha also fired on the informant. The allegation against the present petitioner is that he assaulted Sanjog Lal Srivastava on his head.

The learned counsel for the petitioner has submitted that there is previous land dispute between the parties. There is case and counter case and the members of the petitioner's side have also sustained fire-arm injuries. He has submitted further that there is no allegation on the petitioner to assault the informant, rather there is allegation against him to assault one Sanjog Lal Srivastava, who sustained simple injury. The petitioner is a person of clean antecedents.

Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bikramganj, Rohtas in connection with Samvadi
