2. The accused/petitioner seeks bail in connection with Chakia P.S. Case No.72 of 2025 registered for the offences punishable under Sections 126(2), 115(2), 109, 351(2), 352, 3(5) of Bhartiya Nyaya Sanhita, 2023 (for short 'B.N.S.').

3. The accused/petitioner is named in the FIR and is in custody since 28.10.2025.

4. As per FIR, some altercation took place due to exchange of gutka, where hot exchange of words took place between informant and accused persons, where during the

Patna High Court CR. MISC. No.25009 of 2026(3) dt.15-07-2026 2/3 argument one of the co-accused, namely, Bhushan Kumar assaulted on the head of informant by using bamboo log as a result informant fell to the ground and became unconscious.

It is submitted by learned counsel for petitioner that the FIR itself suggest that the assault on head of the informant was caused by one of co-accused, namely, Bhushan Kumar, who is not the petitioner for the present . It is submitted that Ravi Kumar only alleged to involve in exchange of hot words due to "gutka" issue with the informant. It is submitted that the allegation of physical assault is not attributed to this petitioner. Petitioner claimed clean antecedent. While concluding argument, it is submitted that investigation of this case is already concluded, as such, there is no chance of tampering with the evidence.

6. Learned APP opposed the prayer for grant of bail to the petitioner.

7. In view of aforesaid factual submissions and by taking note of fact as allegation qua causing head assault is not available against this petitioner coupled with the fact that investigation of this case is already concluded, where

No.25009 of 2026(3) dt.15-07-2026 3/3 petitioner, who is a man of clean antecedent remains in custody since 28.10.2025, accordingly, the petitioner, above-named, is directed to be released on bail furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Begusarai, in connection with Chakia P.S. Case No.72 of 2025, subject to the conditions as laid down under Section 480(3) of the Bhartiya Nagrik Suraksha Sanhita (for short 'BNSS').
