JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-11-2015 The present application has been filed for modification of the order dated 07.08.2014 passed in Cr. Misc. No. 32539 of 2014.
The petitioner was initially granted anticipatory bail vide order dated 25.04.2014 passed in Cr. Misc. No. 7832 of 2014 in connection with a complaint case wherein processes were directed to be issued after cognizance being taken for the offences under Sections 406, 420 of the Indian Penal Code. The bail was granted on the undertaking of the petitioner that petitioner will deposit Rs. 50,000/- of the cheque amount but petitioner failed to deposit the said amount and thereafter filed modification application vide Cr. Misc. No. 32539 of 2014 when period of surrender was extended vide order dated 07.08.2014 with a condition to deposit Rs. 8000/- with the District Legal Services Authority, Dalsingsarai, but neither the initial order dated 25.04.2014 nor the subsequent
Patna High Court Cr.Misc. No.50484 of 2015 (3) dt.26-11-2015 2/2 order dated 07.08.2014 has been complied and now a third modification application has been filed.
Considering the nature of accusation, the present modification application is allowed with a condition that petitioner will deposit Rs. 58,000/- with six per cent interest calculated from the date the respective amount fell due till the date of deposit before the authority/or given to the complainant concerned within a period of two weeks from the date of receipt/production of the copy of this order. On payment of the aforesaid amount, the bail bonds of the petitioner shall be accepted in pursuance to the order dated 25.04.2014 passed in Cr. Misc. No. 7832 of 2014. It is made clear that no modification application shall be entertained in future.
Accordingly the modification application is disposed of.
