JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 2 01-09-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Bhagwanpur P.S. Case No.49 of 2020 [G.R. No. 280/202] for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. It is alleged that from Bolero vehicle, total 35.640 litres of foreign liquor was seized. Learned counsel appearing on behalf of the petitioner submits that the petitioner is the driver of the aforesaid vehicle. Petitioner is in custody since 04.03.2020.

Considering the fact that the petitioner has no criminal antecedent and he is in custody since 04.03.2020, the Court is inclined to grant bail to him. The petitioner, named above, is directed to be released on bail on furnishing bail bonds

of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge 2nd -cum- Special Judge Excise Act, Begusarai in connection with Bhagwanpur P.S. Case No.49 of 2020 [G.R. No. 280/202].

Further, on release the petitioner shall render his service as volunteer to combat Covid pandemic for a period of month. He is required to report before the Civil Surgeon, Begusarai-cum-Nodal Officer, Covid.
