JUSTICE ANIL KUMAR SINHA ORAL ORDER 13-10-2020 Heard Mr. Sanjeev Kumar, learned counsel for the petitioner and Mr. Khurshid Anwar, Additional Public Prosecutor for the state through video conferencing.

2. Petitioner seeks regular bail in connection with Nautan PS Case No. 463/2019 registered for the offence punishable under Sections 341, 323, 324, 307, 354B, 379 and 504/34 of the IPC.

3. The allegation against the petitioner, as per First Information Report, is that the informant had purchased a piece of land from Shankar Prasad and Amar Prasad and got it mutated and on the date of occurrence i.e., 05.12.2019, the petitioner and other accused persons arrived at the house of informant and claimed that the land purchased by the informant is their Khatiyani land and all the accused persons, nine in

No.26534 of 2020(2) dt.13-10-2020 2/3 number, started assaulting the informant and his family members with Lathi, Farsa and axe etc, and the allegation against petitioner is that the petitioner caught the hair of sisterin-law (Bhabhi) of the informant and dragged her on the floor and also outraged her modesty.

4. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case along with accused persons and the allegation against him is ornamental in nature. Learned counsel further submits that from perusal of the FIR, it is evident that there was land dispute between the parties and petitioner is in custody since 23.01.2020.

5. Having regard to the submissions made by the parties and taking into consideration the material on record and the fact that there is land dispute between the parties and the petitioner is in custody since 23.01.2020, I am inclined to grant regular bail to the petitioner.

6. Accordingly, let the petitioner, DILIP RAM be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Nautan PS Case No. 463/2019.

7. It is made clear that at the time of furnishing bail
