JUSTICE ASHUTOSH KUMAR ORAL ORDER 25-08-2020 Heard Mr. Prasoon Sinha, learned Advocate for the petitioners and Mr. Abhay Kumar-I, learned APP for the State. The petitioners seek bail in anticipation of their arrest in connection with Sursand P.S. Case No. 438 of 2019 dated 06.12.2019 instituted for the offences under Sections 341, 323, 324, 504, 506, 307 and 34 of the Indian Penal Code.
The petitioners and others are stated to have taken part in the assault in which one of the persons is said to have been injured. The petitioners and the prosecution party are agnates and there is a long
standing dispute between them. Nothing specific has been attributed to the petitioners and the injury report which is on record has not been produced by the I.O.; rather by the prosecution party. That injury report also has been prepared by a private doctor. Regard being had to the nature of accusations against the petitioners and the background facts they are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of this order on their furnishing bail bonds of Rs. 10,000/- (Rs. Ten Thousand) each with two sureties of like amount each to the satisfaction of learned I/C Judicial Magistrate, Pupri at Sitamarhi in connection with Sursand P.S. Case No. 438 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
