JUSTICE BIRENDRA KUMAR ORAL ORDER 06-07-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 406/420/467/468/471/120B of the Indian Penal Code. The allegation against the petitioners is that they had applied for the post of Panchayat Teachers and produced forged certificate of eligibility.

Submission of the learned counsel for the petitioners is that at the stage of scrutiny of the application itself the said document was detected as forged one. The genuineness of the forgery is yet to be established. The petitioner has not benefited

Considering the aforesaid fact, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Birpur, Supaul/Successor Court in connection with Birpur Police Station Case No.58 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. With further condition that petitioners shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioners in this case.
