JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-02-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a complaint case in which processes have been directed to be issued after cognizance being taken for the offences punishable under Section 420 of the Indian Penal Code and Section 138 of the N.I. Act. It is alleged that the complainant fixed mobile tower under an agreement with the petitioner for a sum of Rs.3,00,000/-. The petitioner issued a cheque, which got bounced. It is submitted by the learned counsel for the petitioner that out of Rs.3,00,000/-, Rs.2,00,000/- were paid to the complainant through account payee cheque (account transfer). Notices were issued to the complainant, but in spite of valid service of notice, none is appearing to controvert the

Patna High Court Cr.Misc. No.32592 of 2011 (6) dt.09-02-2015 2/2 contention of the petitioner.

Considering the nature of accusation, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with Complaint Case No.4472 of 2010, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
