The petitioners are apprehending their arrest in connection with Neemchak Bathani P.S.Case no.157 of 2018 , registered for offences punishable under Sections 341, 323, 325, 307, 504 and 34 of the Indian Penal Code. Allegation against the petitioners is if assault by Lathi, causing injury.

Submission of the learned counsel for the petitioners is that both informant and petitioners are own brother and sister and there is land dispute between the parties. Heard learned A.P.P., who has submitted that the opinion on the injury report has not been received up till now. As per

Patna High Court CR. MISC. No.23531 of 2019(5) dt.28-06-2019 2/2 report of the S.H.O. dated 21.6.2019, occurrence is of dated 14.11.2018.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM Xth, Gaya in connection with Neemchak Bathani P.S.Case No.157 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid direction, this application is allowed.
