The petitioner apprehends his arrest in connection with Bihta P.S. Case No. 05 of 2017 registered under Sections 147, 149, 379, 120B of the Indian Penal Code and section 39, 40, 41 of the Mining Act.

Learned counsel appearing on behalf of the petitioner submits that similarly situated co-accused namely Pramod Kumar has already been allowed bail by a Bench of this Court vide Cr. Misc. No. 16759 of 2017 on 07.07.2017. Taking into consideration the above facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the
