Heard the learned counsel for the petitioners as well as the learned A.P.P. for the State.
In this application for anticipatory bail the petitioners apprehend their arrest in connection with Maniyari P.S. Case No. 63 of 2016 for the offences punishable under sections 363 and 366 (A)/34 of the I.P.C.
The victim in her statement recorded under section 164 of the Cr.P.C. has specifically stated that she has solemnized her marriage with Dharmendra Kumar Ram, who happens to be the son of petitioner no.1 and Devar of petitioner no.2 and at the
Patna High Court Cr.Misc. No.37032 of 2016 (5) dt.10-01-2017 2/2 time of recording her statement the victim has disclosed her age as 20 years which is evident from perusal of Annexure-3/1 to the supplementary affidavit. It is also submitted that on this ground Raj Kumar Ram has been allowed bail vide Cr. Misc. No. 35109 of 2016 by another co-ordinate Bench of this Court. In the facts and circumstances as stated above, the petitioners, namely, Lalti Devi and Rinku Devi, in case of their arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of. Sri Mukesh Kumar Mishra, J.M. 1st Class, Muzaffarpur in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
