The petitioner apprehends his arrest in Shikarpur P.S. Case No. 179/2013, registered for the offences punishable under Sections 457 and 380 of the Indian Penal Code. The informant lodged the case against unknown for theft of his motorcycle bearing registration no. BR22E-6386 and one filled gas cylinder from his house.

During the course of investigation, it transpired that one Birja Patel died in a motor accident and his wife produced the stolen motorcycle for which Shikarpur P.S. Case no. 182/2013 was registered under Section 279 and 304A of the Indian Penal Code. Witnesses have stated during course of investigation that, it was the petitioner who was driving motorcycle before the

Patna High Court Cr.Misc. No.33519 of 2016 (3) dt.19-10-2016 2/2 accident. When the accident took place the petitioner fled away leaving the motorcycle on the spot.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
