The petitioner apprehends his arrest in connection with Pipra P.S. Case no. 08 of 2016, registered under Sections 406, 409 and 420 of the Indian Penal Code.
The accusation is that petitioner being the Headmaster of Kaushlipatti School was handed over Rs. 609750/- for construction of the school building, but in the measurement book, out of the said amount petitioner constructed work of Rs. 397931 and it was found that petitioner has misappropriated Rs. 211819/-. Learned counsel for the petitioner submits that there is no dispute that petitioner withdrawn the said amount for construction of the school building, but he completed the said work. Later on, after measurement Block Education Officer, Pipra, Supaul sent a letter bearing No. 77, dated 20.02.2016 to the District Primary Education
Patna High Court Cr.Misc. No.33420 of 2016 (2) dt.24-08-2016 2/2 Officer, Supaul about completion of the work and NOC, which would appear from the report of Block Education Officer, Pipra, Supaul. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M-II, Supaul in connection with Pipra P.S. Case No. 08 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
