The petitioner has preferred this application for grant of regular bail in a case registered u/s 341, 323 and 354 of the Indian Penal Code and 67 of the Information Technology Act. As per the prosecution case, it is alleged that the petitioner was sending obscene messages to the informant. When the informant was returning to home, the petitioner started outraging her modesty. On halla, the petitioner fled away taking advantage of darkness.
Patna High Court CR. MISC. No.24966 of 2022(2) dt.17-08-2022 2/2 Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 25.02.2022. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
Considering the aforesaid facts and circumstances, as well as the nature of allegation against the petitioner, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad (Bihar) in connection with Madanpur P.S. Case No. 86 of 2022. The application stands allowed.
