Petitioner has asked for a preferential right concerning a document executed by another co-sharer Lalan Singh, in favour of Sunil Kumar Singh, brother of petitioner and his wife a co sharer with regard to the property which, as claimed remains joint. Preferential right is not available against co-sharer. Accordingly, the instant petition lacks merit and is accordingly rejected.
