The Petitioner apprehends his arrest in Jamui P.S. Case No.318 of 2016 instituted for the offence under Section(s) 25(1-B)A, 26 of the Arms Act pending in the Court of the Chief Judicial Magistrate, Jamui.

It is alleged in the written report that two persons fled away after leaving the motorcycle on seeing the police. The police searched the motorcycle and recovered one Xerox copy of the voter card, one electric bill both in the name of the petitioner, one country made pistol loaded with two cartridges from the dickey of the motorcycle.

In para 8 of the petition, defence has been taken that the aforesaid motorcycle was stolen away and the arms does not

Patna High Court Cr.Misc. No.31561 of 2017 (2) dt.17-07-2017 2/2 belong to the petitioner, but no such information was lodged by the informant in any police station.

In view of such, this Court does not find it a fit case for grant of anticipatory bail.

Prayer is rejected.

The petitioner may surrender before the Court below and seek regular bail, which shall be considered and disposed of on its own merit without being prejudiced by this order. (Sanjay Priya, J) JA/- U T
