ANJANA MISHRA ORAL ORDER 17-04-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 01.03.2019 in connection with Fatehpur P.S. Case No.61 of 2019 registered for the offence under Sections 272 and 273 of the Indian Penal Code and Sectionss 30(a), 32(II) of the Bihar Excise and Prohibition Act, 2016.

Considering the entire facts and circumstances of the case and that the alleged recoveries were not from his conscious possession but the vehicle which was seized, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Gaya, in connection with Fatehpur P.S.
