JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-10-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor representing the State through video conferencing.

The petitioner apprehends arrest in a case registered for the offence punishable under sections 304B/34 and 201 of the Indian Penal Code.

Petitioner is Gotani of the deceased and it is alleged that she along with other family members subjected the victim to the cruelty and harassment for non-fulfilment of dowry and finally they killed her and secretly disposed of the dead body. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that the petitioner lives in Fatuha, Patna as her husband works in a Factory, Patna and as such she has no concern with the affairs of the victim and her husband.

Patna High Court CR. MISC. No.24647 of 2020(2) dt.08-10-2020 2/2 Petitioner's name has come in the case in the re-statement of the informant merely on suspicion after three months of the occurrence. Similarly situated co-accused Shanti Devi has already been allowed bail by a co-ordinate bench of this Court vide order dated 25.2.2020, passed in Cr.Mis.No. 1307/2020. Learned counsel for the informant and the State oppose the prayer for bail.

In the facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Danapur Patna in Paliganj Police Station Case No. 387 of 2019, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
