JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 14-07-2016 Heard learned counsel for the petitioners and the State. The petitioners apprehend their arrest in a case under section 307 and other allied sections of the Indian Penal Code. The petitioners submit that occurrence took place between residents of two villages on the issue of cremating a dead body of a child in Kabristan. They further submit that co-accused Hazarat is said to have assaulted the SHO with Farsa on his head, whereas petitioner no.1 is alleged to have assaulted him with Bamboo on his leg. However, there was no injury on the leg of the SHO in the injury report.
In the facts and circumstances of the case, in the event of arrest/surrender, let both the petitioners, named in the cause title, be released on bail on furnishing bail bond of Rs.5,000/- each
Patna High Court Cr.Misc. No.25761 of 2016 (2) dt.14-07-2016 with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj in Kataya Police station Case No. 38 of 2016.
