JUSTICE SATYAVRAT VERMA ORAL ORDER 20-05-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Section 30(a) of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 25.03.2022, charge-sheet has been submitted in the case and has antecedent of one case. Allegation is of total recovery of 549 litres of liquor from the vehicles as detailed in the F.I.R.

Learned counsel for the petitioner submits that the petitioner is neither the driver nor the owner of the two vehicles rather had taken lift and thus came to be implicated when the

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 25.03.2022, charge-sheet has been submitted in the case and is neither the driver nor the owner of any of the vehicle, let the petitioner above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Aurangabad Town P.S. Case No. 165 of 2022. (Satyavrat Verma, J) Rishi/- U T
