2. The petitioner seeks regular bail in connection with Nautan P.S. Case No. 157 of 2022, lodged on 04.07.2022, under Section 30(a) of the Bihar Prohibition and Excise Act 2016.

3. As per the prosecution, total recovery of 459 litres of wine has been the subject matter of the present case. There are in total 5 named accused persons in this case.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel submits that the petitioner has not been apprehended from the place of occurrence. His name has figured in this case on secret information. Counsel for the petitioner submits that the antecedent of the petitioner is not clean. There are in total one

Patna High Court CR. MISC. No.27815 of 2024(2) dt.26-04-2024 2/2 criminal case pending against him, in which he is on bail. The petitioner is in custody since 29.02.2024.

5. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner, above named, be granted bail only after framing of the charge, if not framed, on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Learned Exclusive Special Judge, Excise Court No. II, Siwan, in connection with Nautan P.S. Case No. 157 of 2022 subject to the conditions as laid down under Section 437(3) of the Code of Criminal Procedure. (Dr. Anshuman, J) Mkr./- U
