The petitioner seeks bail in Palasi P.S. Case No.331 of 2018 registered under Section 452, 353-A & 354-B of the Indian Penal Code.

Petitioner is said to have intruded into the house of the informant in the midnight and tried to outrage her modesty and was apprehended by the mother of the informant who rushed there responding alarm made by the informant. It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. The petitioner has committed no offence. As a matter of fact, the father of the petitioner had lodged Complaint Case No.2239C/2018 against

Patna High Court CR. MISC. No.23763 of 2019(2) dt.12-04-2019 2/2 the informant and father and mother of the informant preceding to occurrence on 24.09.2018 and to take revenge this false and frivolous case has been lodged against the petitioner. The petitioner has no criminal antecedent and has been languishing in custody since 28.11.2018.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VI, Araria in connection with Palasi P.S.
