Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272, 273, 290 of the Indian Penal Code and 47A of the Excise Act. It is alleged that huge quantity of foreign liquor and bear were recovered in front of the shop of the petitioner. It is submitted by the learned counsel for the petitioner that petitioner is a licensed liquor dealer and recovery has been made in front of the shop under a tree which cannot be treated to be recovered from the possession of the petitioner. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.
The aforesaid facts constitute ground for
Patna High Court Cr.Misc. No.54256 of 2015 (2) dt.01-12-2015 consideration of prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Aurangabad (Town) P.S. Case No. 222 of 2015, pending in the court of learned Chief Judicial Magistrate, Aurangabad. With this observation this application is disposed of.
