JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 16-09-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Complaint Case No. 1629C of 2012 registered under Sections 420, 467 and 468 of the Indian Penal Code.

The allegation of complainant, Vijay Verma, is that petitioner applies for the post of Panchayat Teacher on the basis of forged documents and in collusion with members of the committee got the job of Panchayat Teacher and posted in Upgraded Middle School, Banma.

Learned counsel for the petitioner submits that, in fact,

No.36502 of 2016 (2) dt.16-09-2016 petitioner has filed Title Suit No. 202 of 2010 against the complainant, which is pending in the court of Sub-Judge-I, Saharsa, due to that reason petitioner has falsely been implicated in this case for getting the job of Panchayat Teacher by submitting forged certificate. Further submissions is that Vigilance inquiry is going on regarding the illegalities in appointment of Panchayat Teachers but no any action has been taken against the petitioner till today by the Vigilance Department.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the J.M. Ist Class, Saharsa, in connection with Complaint Case No. 1629C of 2012, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
