The petitioners are apprehending arrest in a case registered for the offences punishable under sections 379 and 411 of the IPC.

The accusation is of stealing the truck bearing registration No. JH 11B 4285, loaded with iron rod. On the next date of the occurrence, co-accused Putul Ram was arrested with the stolen truck, who disclosed the name of the petitioners as participants in the occurrence.

It is submitted by learned counsel for the petitioners that except the confessional statement of co-accused Putul Ram, there is nothing on record to suggest the complicity of the petitioners in commission of the offence. Statement has been made in paragraph 3 of the petition that the petitioners are not having any criminal antecedent. It is further submitted that co-accused Putul Ram has

Considering the fact that the petitioners' name sprang up in the confessional statement of co-accused and statement made in paragraph 3 of the petition that the petitioners are not having any criminal antecedent, let the petitioners above named be released on anticipatory bail in the event of arrest or surrender within 12 weeks on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Vaishali at Hajipur in connection with Hajipur Sadar P.S. Case No.383 of 2017 subject to the conditions laid down in Section 438(2) of the Cr.P.C.
