The present application has been filed on behalf of the petitioner seeking modification of the order dated 19.03.2014 passed in Cr.Misc.No.1011 of 2014, whereby the petitioner was granted anticipatory bail in connection with Digha P.S. Case No.161 of 2012 pending in the court of learned Judicial Magistrate-1st Class, Patna with certain conditions provided he surrenders in the court below within a period of four weeks. Learned counsel appearing on behalf of the petitioner submits that, due to serious ailment of the petitioner, he could not surrender in the court below within the time prescribed by this Court and, therefore, he could not avail of the privilege of anticipatory bail granted by this Court. Hence, a prayer has been made for extension of time for surrender of the petitioner in the court below for being released on bail in terms of the aforesaid order dated 19.03.2014 passed in Cr.Misc.No.1011 of 2014. Patna High Court Cr.Misc. No.51967 of 2014 (3) dt.13-04-2016 consideration the facts pleaded in the present application, the prayer for modification is allowed. The order dated 19.03.2014 passed in Cr.Misc.No.1011 of 2014 is modified only to the extent that, if the petitioner surrenders in the court below within a period of four weeks from today, then he shall be released on bail on the same terms and conditions, which has been indicated in the aforesaid order dated 19.03.2014.

The present application stands allowed to the extent indicated above.
