Mr.Jagdhar Prasad ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-04-2019 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is in custody in connection with S.Tr. No. 405 of 2018 arising out of Baruraj P.S. Case No. 102 of 2017, registered for the offence punishable under Section 395 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner was not named in the F.I.R., his name surfaced on the confessional statement of co-accused Sujit Kumar. Learned counsel for the petitioner submits that petitioner was remanded in this case on 14.11.2017 but till date he has not been put on T.I.P. He further submits that co-accused Rajesh Kumar @ A.T.M. has been granted bail by co-ordinate Bench of this Court in CR. Misc. No. 28183 of 2018 vide order dated 10.05.2018.

No.23104 of 2019(2) dt.10-04-2019 2/2 Considering the fact that the co-accused has granted bail by co-ordinate Bench of this case and as yet petitioner has not been put on TIP, the Court is inclined to grant bail to the petitioner. Let, the petitioner named above be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Additional District & Sessions Judge-13th, Muzaffarpur in connection with S.Tr. No. 405 of 2018 arising out of Baruraj P.S. Case No. 102 of 2017.
