JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 18-12-2015 The petitioner apprehends his arrest in a case instituted under Sections 341,323,324,307,504,448,147,148,149, and also added Section 302 of the Indian Penal Code.

The petitioner submits that there is specific overt act against others and the allegation levelled against him is general in nature.

Considering the facts of the case, in the event of arrest or surrender before the Court below within four weeks from today, let the petitioner be released on bail upon furnishing bail bonds of Rs. 5000/-(five thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Raxaul at Motihari in Palanwa P.S. Case No. 77 of 2015 subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
