Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners seek pre-arrest bail in connection with Daud Nagar P.S. Case No. 183 of 2017 registered under Sections 366A, 323, 504, 506 and 120B of the Indian Penal Code.
It is submitted by the learned counsel for the petitioners that the petitioners had no role in abduction of the
Patna High Court Cr.Misc. No.48599 of 2017 (2) dt.18-10-2017 daughter of the informant. As a matter of fact, a ceremony of marriage has been performed between Kundan Kumar and alleged victim Gitanjali Kumari before the Marriage Officer-cum-Registrar, Danapur, Patna on 12.09.2017 and, since then, they were living together as husband and wife. In support of his submission, my attention has been drawn towards Annexure-2 to the supplementary affidavit filed on behalf of the petitioners, which is certificate of marriage dated 12.09.2017. It is further contended that in the statement recorded under Section 164 of the Cr. P.C. of the alleged victim, she has categorically stated that she went along with Kundan Kumar on 03.06.2017 at about 12:00 p.m. in the day went to Ara and, thereafter, they proceeded towards Delhi after taking train and they solemnized married on 05.06.2017 in Durga temple.
Learned counsel for the State submitted that the alleged victim is stated to be a minor aged about 14 years. Be that as it may, regard being had to the fact that in her statement made under Section 164 Cr. P.C., the victim has not stated a word against the petitioners, in the event of arrest or surrender in the court below within six weeks from today, they are directed to be released on bail on furnishing bail bond of Rs.
Patna High Court Cr.Misc. No.48599 of 2017 (2) dt.18-10-2017 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Daud Nagar, Aurangabad in connection with Daud Nagar P.S. Case No. 183 of 2017 subject to the conditions as laid down under Section 438(2) Cr. P.C.
