JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 13-04-2016 The ground urged by the counsel for the petitioner that there was some kind of confusion in the mind of the learned Single Judge with regard to the two cases and the suspensions which were affected because of the two cases is not entirely correct. What is being urged is of no consequence. The fact is that the petitioner was made an accused in two different police cases. He was put under suspension and in one of the cases he has been subsequently acquitted but because in the second case he remained under custody for a long period of time, he was deeming suspension which took effect is not in dispute. Keeping the above in mind, the learned Single Judge has rightly held that only after the accused is
Patna High Court C. REV. No.92 of 2014 dt.13-04-2016 2 / 2 acquitted, he can approach the authorities for settlement of payment of salary etc. even for the period of suspension. There is no error on the face of record which is required to be corrected in the review application.
Review application is dismissed.
