2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 127 (1) , 115 ( 2 ), 303 ( 2 and 3 (5) of the BNS.
3 . As per F.I.R., dispute over pathway led to maarpeet in which it is alleged that all the F.I.,R., named accused persons along with 4 to 5 unknown persons entered the house of informant and assaulted son of informant.
4. It is submitted on behalf of the petitioners that both parties are co-villagers and there is admitted dispute between
Patna High Court CR. MISC. No.28189 of 2025(2) dt.13-05-2025 2/2 the parties over pathway due to which, a simple occurrence of maarpeet took place between them. Allegation of assault is general and omnibus against these petitioners. Injury allegedly caused by these petitioners are simple in nature . Petitioner Nos. 1 and 3 claim clean antecedent and petitioner No. 2 has got one antecedent.
5 . Learned counsel for the State oppose the bail petition .
6. Considering the nature of injury and other circumstances of the case , in the event of arrest or surrender within eight weeks from today , let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM Begusarai ( Bihar ) in connection with Bachhwara P.S. Case No. 325 of 2024 , subject to the conditions laid down under section 482 ( 2 ) of the Bharatiya Nagarik Suraksha Sanhita ( BNSS) , 2023 . (Prabhat Kumar Singh, J) Koushik/- U
