2. Petitioners apprehend their arrest in connection with Jagdishpur P.S. Case No.521 of 2023 instituted under Sections 147, 149, 341, 323, 379, 307, 504 and 506 of the Indian Penal Code.
3. As per the prosecution case, when the informant was sitting at his door, the accused persons including the petitioners came there with lathi, danda and iron rod and assaulted the
Patna High Court CR. MISC. No.27146 of 2024(2) dt.01-05-2024 2/2 informant and his family members causing injury to them.
4. Learned counsel for the petitioners submits that petitioners are quite innocent and have falsely been implicated in this case due to land dispute. There is case and counter case between the parties. He further submits that due to land dispute minor scuffle took place between the parties and the injuries found on the injured are simple in nature. The petitioners have no criminal antecedent.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.
6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Bhojpur, Ara in connection with Jagdishpur P.S. Case No.521 of 2023, subject to the conditions as laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
