The present application has been filed for cancellation of bail of opposite party no. 2 granted vide order dated 21.04.2011 passed in Cr. Misc. No. 10584 of 2011 which was subsequently confirmed by learned SDJM, Saran at Chapra vide order dated 10.11.2011 in connection with Complaint Case No. 2791C of 2009 wherein process has been directed to be issued after cognizance being taken for the offences punishable under Sections 498A of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.
It is submitted by learned counsel for
Patna High Court Cr.Misc. No.28435 of 2012 (3) dt.28-09-2012 2/2 opposite party no. 2 that earlier also the complainant-petitioner came before this Court with the similar prayer for cancellation of bail vide Cr. Misc. No. 4079 of 2012 which was disposed of vide order dated 08.02.2012 as not maintainable. It is further submitted that the matrimonial harmony has not been restored due to the apathetic attitude of the petitioner-complainant. Considering the above facts, this Court finds no merit in this application and accordingly, it is dismissed. (Dinesh Kumar Singh, J) DKS/- U T
