ANJANA MISHRA ORAL ORDER 15-10-2015 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Tariyani P.S. Case No.23 of 2015 for allegedly having committed the offence under Section 47A of the Excise Act.

Learned counsel for the petitioner submits that the petitioner has no concern with Bolero vehicle, which is alleged to have been recovered from the possession of two persons though it is stated that they have taken the name of one Sanjeev Kumar Singh with different parentage, being the owner of the vehicle in question. Learned counsel for the petitioner further submits that neither the petitioner is the owner of the vehicle

Patna High Court Cr.Misc. No.30106 of 2015 (3) dt.15-10-2015 2/2 nor has he any concern with the said Bolero.

Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedents, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheohar, in connection with Tariyani P.S. Case No.23 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) PNM U T
