JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 28-09-2016 The present application has been filed for cancellation of bail of opposite party no. 2 granted vide order dated 11.04.2012 passed in Cr. Misc. No. 12528 of 2012 in connection with Kadamkuan P.S. Case No. 386 of 2011 registered for the offences punishable under Sections 498A, 494 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act. The opposite party no. 2 was granted bail on the undertaking that he will make payment of Rs.1,500/- to the informant-petitioner by depositing the same in the bank account of the informant-petitioner by second week of every succeeding month. The opposite party no. 2 deposited the undertaken amount for 2-3 months and thereafter he did not deposit the same.

Patna High Court Cr.Misc. No.32807 of 2012 (2) dt.28-09-2016 2/2 It is very fairly submitted by learned counsel for the petitioner that subsequent to order dated 11.04.2012 passed in Cr. Misc. No. 12528 of 2012 opposite party no. 2 made default as a result his bail bond was cancelled and subsequently he was granted bail by learned court below, though, no statement to that effect has been made in the petition.

Keeping in view of the above submission of the learned counsel for the petitioner, the present application filed for cancellation of bail of opposite party no. 2 has become infructuous and, accordingly, it is disposed of. (Dinesh Kumar Singh, J) DKS/- U T
