The petitioner, apprehending his arrest in connection with Goraul P.S. Case no.283/15 registered for the offence under Sections 272, 273 of the Indian Penal Code and Section 47(A) of the Excise Act, has prayed for grant of anticipatory bail. Learned counsel for the petitioner submits that from a Gumti, huge quantity of country made and foreign liquor was recovered. Though the Gumti does not belong to the petitioner, it has been alleged that petitioner is owner of the Gumti and he has been made accused in the present case.

Patna High Court Cr.Misc. No.47642 of 2015 (2) dt.15-10-2015 2/2 Prosecutor has opposed the prayer for anticipatory bail of the petitioner. He submits that from the order impugned, it is evident that the petitioner was owner of the Gumti in question. Keeping in view the nature of accusation, the Court is of the opinion that it is a fit case for extending the privilege of anticipatory bail. Let the petitioner, namely, Bittu Kumar @ Rajan Kumar, in the event of his arrest or surrender within eight weeks from today, be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali in connection with Goraul P.S. Case no.283/15, subject to conditions as laid down in Section 438(2) of the Code of Criminal Procedure.
