JUSTICE SUDHIR SINGH ORAL ORDER 06-07-2017 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.

The petitioners are apprehending their arrest in connection with Banka P.S. Case No. 188 of 2017, G.R. No. 817 of 2017 for the offences instituted under Sections 147, 149, 337, 353, 431, 437 and 438 of the Indian Penal Code. The prosecution case, in brief, is that one school girl was dashed by a track due to which she fell down and died immediately. Thereafter the mob set the vehicle on fire. It has been submitted on behalf of the petitioner that the petitioners have falsely been implicated in the present case. There is no allegation of tampering of witnesses alleged against the

Patna High Court Cr.Misc. No.28598 of 2017 (2) dt.06-07-2017 2/2 petitioners. General and omnibus allegation has been made against the petitioners. No specific overt act has been alleged against the petitioners.

On behalf of the State, it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Banka P.S. Case No. 188 of 2017, G.R. No. 817 of 2017 on furnishing bail bonds of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Banka, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
